Terms and Conditions of Service
By accessing or using the Speed Rabit application, you agree to be bound by these Terms, Policies, and applicable laws.
1. Nature of the Platform
Speed Rabit is a technology-driven marketplace. We provide a platform that connects users with third-party vendors (merchants) and independent delivery partners.
- The Facilitator Role: You acknowledge that Speed Rabit does not manufacture or prepare food/groceries but facilitates the sale and logistics.
- Contract of Sale: The contract for the sale of goods is between the User and the Merchant. The contract for delivery is between the User and the Delivery Partner.
2. Account Eligibility & Security
- Age: You must be at least 18 years of age.
- Account Accuracy: You are responsible for providing the correct delivery address and contact number. Speed Rabit is not liable for failed deliveries due to incorrect user data.
- One Device Policy: To prevent promo-code abuse, we may limit accounts to one unique mobile device.
3. Pricing, Payments, and Taxes
- Dynamic Pricing: Prices on the app may vary from the physical store prices due to merchant commissions or platform handling fees.
- Surge Fees: During periods of high demand, bad weather, or traffic, Speed Rabit reserves the right to charge a “Surge/Rain Fee” to incentivize delivery partners. Any surge, rain, high-demand, or additional fee will be clearly shown to the user before order confirmation.
- Taxes: All prices are inclusive of applicable GST unless stated otherwise.
Speed Rabit shall not be responsible for payment failures caused by banks, UPI providers, card networks, or third-party payment gateways.
4. Specific Category Rules
- Perishables (Fruits/Veg/Food): Once an order is placed, it cannot be returned or refunded unless there is a quality defect verified at the doorstep.
- Pharmaceuticals: You must upload a valid prescription. Speed Rabit reserves the right to cancel orders if the prescription is expired or invalid.
- High-Value Electronics: Delivery of electronics (above ₹5,000) requires a mandatory Secure OTP verification.
5. Cancellation & No-Show Policy
- User Cancellation:A reasonable cancellation fee, up to 100% of the order value, may be charged depending on the stage of order processing, to compensate vendors and delivery partners.
- Waiting Fee: Delivery partners will wait for a maximum of 5 to 7 minutes at the delivery location.If the user is unreachable, the order may be marked as "Completed", and refunds will be subject to review based on order status and applicable laws.
6. Limitation of Liability & Indemnity
- Quality of Goods: Speed Rabit is not liable for the quality, safety, or legality of items sold by merchants.
- Delivery Accidents: While we prioritize safety, Speed Rabit is not liable for any delays caused by traffic, weather, or unforeseen technical glitches.
- Indemnity:You agree to indemnify Speed Rabit against any claims arising from your misuse of the platform or violation of these terms.
7. Dispute Resolution & Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.
The seat and venue of arbitration shall be Nellore, Andhra Pradesh, and the proceedings shall be conducted in Telugu or English.
8.Intellectual Property
The name "Speed Rabit," the Rabit logo, the app interface, and the proprietary routing algorithms are the sole property of Rabit soft solutions . Any unauthorized scraping of data or cloning of the app will lead to legal action under the Information Technology Act, 2000.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the competent courts at Andhra Pradesh.
10. Force Majeure
Speed Rabit shall not be liable for delays or failures caused by floods, strikes, pandemics, natural disasters, government restrictions, or events beyond reasonable control.
